This act mandates human immunodeficiency virus/acquired immunodeficiency syndrome (HIV/AIDS) prevention education beginning in grade 5 and continuing through grade 12. Students will receive such education at least once each school year beginning no later than grade 5.

The HIV/AIDS prevention education program will be developed in consultation with teachers, administrators, school nurses, parents/guardians and other community members including, but not limited to, persons from medical, public health and mental health organizations and agencies. The curricula and materials used in the HIV/AIDS education program may be the model curricula and resources available through the Office of Superintendent of Public Instruction (OSPI) or if developed by the school district be approved for medical accuracy by the Department of Health (DOH), Office of Infectious Disease. Upon submission of the affidavit and curricula, the district may use these materials while the approval procedure by the DOH Office of Infectious Disease is being completed.

At least one month before teaching HIV/AIDS prevention education in any classroom, the district will notify parents/guardians that instruction will take place. Parents/guardians will be offered at least one presentation during weekend and evening hours concerning the curriculum and materials that will be used for HIV/AIDS education, allowing an opportunity to view the curricula and materials.
